Real estate transactions are governed by a wide body of federal statutes and a combination of state statutes and common law. The requirements established by California state law often differ significantly from other states.
Purchasing and selling of commercial and residential properties are complex transactions involving various contracts, warranties, agency relationships, lenders, HOA's, and county and city zoning ordinances. It is the job of each party's real estate broker to protect the client and to ensure compliance with the laws and procedures, and most brokers perform and admirable job in getting things done correctly.
Unfortunately, sometimes transactions are flawed. Non-disclosure of defects, ambiguous contract terms, negligent real estate brokers, or outright fraud by a party can necessitate attorney involvement.
Wm. Scott Ayers has been a licensed and active real estate broker in California since 1994, and he is familiar with the innocent errors, as well as the occasional willful misconduct, that can cause a deal to fail. He has successfully represented many buyers and sellers over the years, in arbitration and litigation of failed real estate trransactions.
